Website Terms and Conditions of Use Relating to www.bagmee.co.za Bagmee (Pty) Ltd

These Terms and Conditions (“the Terms and Conditions”) govern your (“the Users”) use of the Bagmee (Pty) Ltd (“Provider”) website located at the domain name www.bagmee.co.za (“the Website”). By accessing and using the website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download and/or otherwise copy or distribute Content obtained on the website for marketing or other purposes without the consent of the Provider.

Electronic Communications

By using this website or communicating with the Provider by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures or any other communication satisfies any legal requirements, including but not limited to the requirements that such communications should be in writing.

E-Commerce and Privacy

The website bagmee.co.za sells handbags online. The use of any product bought from this website is at the purchaser/users own risk. The purchaser/user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in strictest confidence by the Provider and not sold or made know to third parties. Only the necessary information, that is the delivery address and contact number will be made known to the third party delivering the product.

The Provider undertakes that it has taken all responsible precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device which may result due to the lack of adequate virus protection software or spyware that the User may have inadvertently installed on his/her device.

Payment methods and Credit Card Security

Payment may be made via Visa or MasterCard credit cards or by EFT (electronic bank transfer) into the Provider’s bank account, details of which will be provided via email after checkout.

EFT payments must be made within 2 hours and proof of payment emailed to support@bagmee.co.za. Failure to do so will result in the order being cancelled.

Credit card transactions will be acquired for the Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.

Products cannot be reserved by a User to be bought at a later time. Placing an item in your cart without processing the payment for the order will not lead to a successful order being placed or the reservation of (an) item(s).

If User’s cart expires without payment being made, this item will be released back onto the website for sale.

Availability

Please note that the stock of all items on offer is limited. Bagmee will make all reasonable attempts to ensure that product sales are brought to an end when stock runs out.

If it happens that Bagmee is unable to fulfil any order at the advertised price because stock is sold out or unavailable, Bagmee will let you know and you'll be entitled to a full refund for the rand value of such product.

Cancellation of Suspected Fraudulent Orders

Bagmee reserves the right to cancel or refuse to fulfil any order that it suspects of being fraudulent. This includes but is not limited to instances of suspected stolen credit cards.

On occasion, the Provider may request a copy of your official identification document or the front of your credit card to verify the transaction with the relevant bank. Bagmee may cancel any order where the necessary documentation is not provided in a timely manner (usually within 24 hours).

In the event of a fraudulent purchase being placed on Bagmee, cardholders will be advised to initiate a chargeback via their bank in order to be refunded. Bagmee does not process refunds for orders suspected of fraud.

Delivery of products ordered

The Provider aims to deliver the product to you at the place of delivery requested by you in your order. We aim to deliver within the specified time indicated on your order however these times are an estimation only.

If we are unable to meet our estimated delivery date we will inform you via email. The Provider shall not be held liable to the User for any losses, liabilities, costs, damages, charges or expenses arising from late delivery. Returns, Exchanges and Refunds

If on receiving your order you are not satisfied with your purchase, let our customer services team know within 7 days and we will gladly collect at our expense and provide you with an exchange or a full refund provided the item is in its original condition and packaging.

Gift Vouchers

Gift vouchers can only be used to make purchases on the bagmee.co.za website. The gift card is valid for 1 year. If your gift card has not been applied to your account before then, it will expire. The voucher can be sent to you or your chosen recipient via email. Gift vouchers are not refundable for cash once purchased.

If the credit of a gift voucher is insufficient for the order you wish to make, you may make up and pay in the difference through one of the other payment methods. Should the purchase price of the product chosen be less than the value of the gift voucher, the value of the difference will be given in a new gift voucher.

Promotional Codes

From time to time Users will receive promotions in the form of unique codes that can be used at checkout to unlock certain discounts.  

Promotional codes are issued at the discretion of Bagmee. Users do not have the right to promotional vouchers and cannot earn them. A code can only be used once and only one voucher can be used per checkout. Enter the voucher code at checkout and the value of the code will be deducted from the total amount in your shopping cart. The remaining balance, if any, must be paid by you.

Copyright and Intellectual Property Rights

Provider provides certain information at the website.

Content currently or anticipated to be displayed at this website is provided by the Provider, its affiliates and/ or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“The Content”). All such proprietary works, and the compilation of the proprietary work, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (”The Owners”), and is protected by South African and International copyright laws.

The Providers reserve the right to make any changes to the website, the Content, or to the products and/ or services offered through the website at any time and without notice.

All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other intellectual Property Rights in or to the Content.

Private surfing

The User may visit the website without providing any personal information.

The website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the website, pages viewed, etc.

The Provider uses this information to determine use of the website, and to improve content thereon. The Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from here

Security

Any person that delivers or attempts to deliver any damaging code to the Bagmee website or attempts to gain unauthorised access to any page on this website shall be prosecuted and civil damages shall be claimed in the event that Bagmee suffers any damage or loss.

You agree and warrant that your login name and password shall:

  1. be used for your personal use only; and
  2. not be disclosed to any third party.

You allow Bagmee to take all reasonable steps to ensure the integrity and security of the website and back-office applications. All credit card transactions are Secure Socket Layer encrypted.

Governing Law and Jurisdiction

This website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law.

If the User accesses the website form locations outside of South Africa the User is responsible for compliance with local laws.

These Terms and Conditions shall be governed by the laws of the Republic of South Africa and the User consents to the jurisdiction of the High Court in South Africa in the event of any dispute.

Limitation of Liability

The website and all Content on the website, including any current or future offer to products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. 

The Owners make no warranty or representation as to the availability, accuracy, or completeness of Content.

Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.

We reserve the right to modify and change the Terms and Conditions at any time. Any changes to this policy will be published on our site.
